Agreement: Hana Kamea Kemble, hereby referred to as “Licensor,” confirms the following by her signature:
Ownership and Rights to License: The Licensor asserts ownership of, or the right to license, the copyrighted material related to The Moving Child Films (including but not limited to Films I, II, or III) as outlined on the official website listed above.
Purpose and Scope of License: The Licensor grants the Licensee a non-exclusive, worldwide, royalty-free, irrevocable license valid for three (3) years. This License permits the Licensee to provide the copyrighted material in streaming video format for the educational benefit of its patrons, students, or staff. The material, herein referred to as “Copyrighted Material,” must be made accessible only to the Licensee’s currently registered users (“Authorized Users”). This License is contingent upon the Licensee implementing reasonable technical safeguards to prevent the downloading of the Copyrighted Material and ensuring it is not publicly posted but is secured via password protection or similar measures.
Warranties and Representations: The Licensor represents that the Copyrighted Material is either her original work or she has secured the necessary rights to grant this License. The Licensor further assures that the Copyrighted Material does not infringe on any third-party copyrights to the best of her knowledge, and that all permissions from third-party copyright holders have been obtained to enact this License.
Acknowledgment of Authorship: The Licensee must clearly attribute Hana Kamea Kemble and any co-authors, where applicable, as the author(s) or owner(s) of the Copyrighted Material. Additionally, any promotional or informational content about the films should include a reference and hyperlink to The Moving Child Films website.
Retention of Rights: The Licensor retains all rights not explicitly granted in this License, including but not limited to the rights to copy, distribute, publish, display, or modify the Copyrighted Material, and to transfer, assign, or license these rights.
